Richard Bloch, JD
Expert in mental health professionals laws, regulations, and ethics.
General Counsel to the Maryland Psychological Association since 1979
Richard Bloch is President of Shiling, Bloch & Hirsch, P.A. and has been in private practice in Maryland since 1972. He received his B.A. from the George Washington University and his J.D. from the University of Maryland School of Law. He is admitted to practice in Maryland, the United States District Court for the District of Maryland, the United States Court of Appeals, Fourth Circuit, and the Supreme Court of the United States. His practice focuses primarily on health law, representation of healthcare providers before the Boards of Examiners, general business law, estate planning and administration, and civil litigation. He is a member of the Maryland State Bar Association and the Baltimore County Bar Association. Mr. Bloch has been General Counsel to the Maryland Psychological Association since 1979. He has written numerous articles and lectures frequently on legal and ethical issues pertaining to the practice of mental health.

WORKSHOP OVERVIEW
The workshop will provide an overview of current legal and ethical issues impacting the practice of mental health, including confidentiality, records, tele-health, boundaries and courts. We will discuss the updated and new provisions of the Maryland, D.C. and Federal laws and regulations applicable to mental health providers, and the statutory and association ethical codes. We will review issues relating to clinical practice, including informed consent, interacting with clients, avoiding inappropriate and/or unintended consequences. and the role of the practitioner in the court system. The session will also discuss planning for retirement, emergencies, and death.

Explain the analytical processes that must be followed in resolving ethical issues.

Describe the mental health practitioner’s obligations regarding informed consent and disclosing potential conflicts to the client.

Recognize the expanded Maryland Minor’s Consent to Treatment law.

Explain the mental health practitioner’s role in responding to subpoenas and in court proceedings.

Afternoon Session:
& Duty to Warn for Maryland and DC Mental Health Professionals
WORKSHOP OVERVIEW
This workshop will provide an overview of current legal and ethical issues relating to the Maryland, D.C. and Federal laws and regulations relating to mandated reporting of child and vulnerable adult abuse and neglect, and laws pertaining to the Duty to Warn. This workshop will review the provisions of these laws, the impact on confidentiality and clinical issues. The workshop will look at the limitations of the scope of these laws and the analysis necessary to determine if an event falls within the exceptions set forth. We will also discuss the consequences of failing to report.

At the conclusion of the training attendees will be able to:

Explain the definitions and provisions in the abuse/neglect reporting laws.

Recognize when a reportable incident of abuse or neglect has occurred.

Identify where and how to report an incident.

Identify where and how to report an incident that occurred out of state.

Explain the requirements for reporting an incident.

Explain the consequences of failing to report.
-
Explain the duty to warn and the statutory elements for immunity.

Organizations, not individual courses, are approved as ACE providers. State and provincial regulatory boards have the final authority to determine whether an individual course may be accepted for continuing education credit. Maryland CEU Institute maintains responsibility for this course. ACE provider approval period: 05/04/2022 – 05/04/2023. Course Completion Requirements:
To earn CE Credit attendees must fulfill the following:

Login to the training (Zoom) on time and ensure that you first and last name are showing in Zoom (message staff if unsure or need help).

Complete a separate Virtual Sign-In Sheet by training start time (link provided in Zoom).

Attend training in full and participate.

Complete separate Virtual Sign-Out Sheet/Evaluation at conclusion (link provided in Zoom with 15 minute timeframe to begin or complete eval).
If all of the above criteria are met your CE certificate will be emailed to you within 7 days of training completion. If above criteria are not yet you may have credits deducted or may be unable to receive any credits. See Terms of Service for full details.
